Ethics of Grief: Profiting from the Pain of Others

Imagine you and a friend go to see a documentary (or even fictional film) about the plight of victims of famine, war, disease, or oppression, and you bawl uncontrollably throughout the film as your friend sits next to you unmoved and indifferent to everything happening on the screen. You think anyone who isn’t moved by the extreme suffering you’ve just seen must be some kind of monster (or a sociopath at the least). You feel, in short, that crying is more moral than just sitting there.

You will admit, of course, that your crying through the movie didn’t help the victims any and your friend’s indifference didn’t really hurt anyone. Still, it seems that a moral person should have feelings for those who are suffering, even if you can’t find any real benefit for these strong feelings for strangers who get no benefit from your tears, heartfelt as they are.

In fact, your friend might point out that you are getting all worked up for no reason, and it might be better to keep your emotions in check. Your wailing for these strangers won’t change anything for them, but it might impair your ability to attend to problems you can change. What good are you to your children, for example, if your mind is on the poor souls in some far corner of the world? You should get your head together, friend, and get on with the business of life.

But, you counter, if you learn to be indifferent and unmoved by the pain of strangers, you may become indifferent to the pain of others, including friends and, yes, your own children. You don’t want to become the kind of monster you now suspect your friend of being. You want to be the kind of person who is moved by the suffering of others. You may not be able to help in every situation, but you do not want to become callous and cold. You want to be a caring individual. It isn’t about what you can do but about what you are.

And now your friend points out that not only did you cry during the movie, but you seemed, in some sense, to enjoy it. In fact, you apparently went to the movie with the prior intention of being moved to tears. You chose the movie because it was described as “moving” and “emotionally riveting.” Will you be happy when your children fall ill because it will satisfy your need to “let it all out”? Perhaps you are the monster, after all?

You didn’t enjoy the pain, you object, but you enjoyed the high quality of the film and its ability to elicit the pain. It was beautiful in its ability to enlarge compassion and trigger a caring response. The film will help, if nothing else, audiences develop a greater sense of concern for others, even if it doesn’t affect everyone (with a sly and disapproving nod to your friend).

And your friend now points out that people had to suffer in order to expand compassion and develop a greater caring response, so the suffering of others is used as a means to your own ends. You are actually acting selfishly after all, and the film makers are also exploiting the suffering of these people in order to teach a moral lesson and even to make a profit and perhaps sit in the spotlight after receiving coveted awards. You can just imagine the director’s teary expressions of gratitude and exhortations for a more acts of compassion at the ceremony.

In 2012, comedian Anthony Griffith told the story of his daughter’s cancer in a moving performance for The Moth. The video quickly went viral. You can see the video here:

The video on YouTube now has more than 1.8 million views. It is almost impossible to watch the video without sobbing, and people shared it by promising that anyone watching should have some tissues on hand. For reasons that aren’t entirely clear, we enjoy experiencing his grief with him. It might be objected that we are emotional voyeurs watching a sort of grief porn. By watching, we are not helping his daughter, we are not preventing future cancer deaths, we are not improving medical care, and it isn’t clear how we might be improving ourselves.

Paradoxically, we simultaneously want to avoid our own pain but glom onto the pain of others. Watching the story enables us to experience the pain without having to actually experience the loss of child. Doing this while watching a fictional account of loss seems justifiable in many ways, but to seek out a chance to cry and experience this kind of pseudo-grief that is provided by the actual grief of another person certainly raises an ethical concern.

We might say that Anthony Griffith needed to talk about his loss, and we are providing him with an audience. We are doing him a great favor by listening. We are honoring his loss. And he may agree with us. In this case, he is using us to help him along his healing journey, but this doesn’t seem to be what is going on. We want to see and hear his story. We want to be part of his grief story without having to do any heavy lifting ourselves. We watch the video, feel emotional excitement, hug our loved ones because one never knows when they will be gone, and then we are done with it.

We might say that we want to hear the story because it is well written and well performed. Griffith is extremely talented as a story teller, and we appreciate his talent and courage to share such a personal story. When we watch the video, we are paying tribute to his writing and his acting. The only problem is that he really doesn’t seem to be acting. He has merely put his pain on view for the world. He is certainly talented, and the story is well-written, but most people will be moved by anyone’s story of a lost child. It is relatively easy to evoke strong emotions with a story of intense pain and grief.

It may be that we want to hear his story so we can prepare ourselves for the times our story might be the main event. Someday we will have to do the heavy lifting. If we can live through Griffith’s pain, maybe we can face our own. By experiencing Griffith’s grief, we see that we can also face it and live through it just as he has done. We finish the video feeling somehow more prepared.

Or we may be drawn to the stories of others because it provides an evolutionary advantage. By hearing stories of others, we develop compassion and care. Other than providing an audience, we may not be helping Griffith directly, but we may be better able to empathize with others in the future. We are preparing not only for how to face our own struggles but to help others through theirs. If this is true, then we are actually doing something noble and beneficial by watching such videos.

Or, maybe we are just seeking the thrill of an emotional roller coaster ride.

Four Ways to Grieve Unethically

My wife and I recently led a discussion on the ethics of grief with a group of psychotherapists. Wishing to challenge the claim that there is no wrong way to grieve, I asked the group to consider boundaries they would place on proper and improper grieving. For the most part, they were a cooperative group, but they were certainly reluctant to declare any way of grieving to be unethical or wrong. Sometimes our conditioning is strong. When the workshop was over, one of the participants asked me what sorts of grieving I think are unethical or inappropriate.

My answer is really simple. I think you are clearly grieving unethically if you let your personal pain compel you to hurt others. I also think you are grieving unethically if you let your personal pain compel you to hurt yourself, but I don’t think that claim is so obvious as the first one.

Some examples:

  1. Homicidal rage—I’m not saying this happens often, but someone overcome with grief Embodiment-of-revenge-by-Roneswho goes on a killing spree is acting unethically for sure. After Ivan López opened fire at Ft. Hood military base, killing three and wounding 16 others before killing himself, friends speculated that it was a reaction to grief over his mother’s death.
  2. Lying and cheating—In her book, Wild, Cheryl Strayed described the emotional turmoil she experienced in the wake of her mother’s death. In her agony, she turned to casual sexual relationships and substance abuse for comfort, tearing apart her marriage and leading her to lie to her husband and other family members. She eventually found better means of coping, of course, but she still regrets the pain and harm she caused those who loved her.
  3. Alcohol and other drugs— The philosopher, Bertrand Russell, took a fairly standard Stoic response to grief, saying it is acceptable to grieve so long as it is not to excess. He says we should distract ourselves from our grief with other pursuits, so long as they are not harmful to us. In his words: “I do not of course deny that a man may be broken by sorrow, but I do say that every man should do his utmost to escape this fate, and should seek any distraction, however trivial, provided it is not in itself harmful or degrading. Among those that I regard as harmful and degrading I include such things as drunkenness and drugs, of which the purpose is to destroy thought, at least for the time being.” Self-harm is harm, and we do have ethical obligations to care for ourselves.
  4. Demanding but not offering emotional support—Many people repeat an unsubstantiated claim that most parents who lose a child will divorce within a year of the child’s death. This claim is not substantiated by any sort of study and seems to be more intuition than anything else. Nonetheless, it is true that some people who are overcome by grief are unable to provide emotional support to others even though they are receiving and expecting emotional support from those same family members or friends. It is a special kind of cruelty to ask someone in the vice-grip of unimaginable grief to provide emotional comfort and support while being left to drown in sorrow alone and adrift. If you find yourself overwhelmed by grief and unable to provide support to the rest of your family, please help them or at least permit them to find other sources of support. If you can’t provide what they need, at least do not become an obstacle to their mental health and comfort.

Anyone who has grieved has probably felt judged for his or her style of grief. As a result, we rush to say that there is no wrong way to grieve, but this bold (and wrong) assertion prevents us from having discussions about the correct ways to grieve. When our grieving causes harm to others or ourselves, it is not merely unhealthy—it is unethical.

A conversation about ethical grieving is worth having, and we can have it without shaming those who are suffering from grief. We can improve our own grieving and our reactions to grief if we can establish an ethics of grief that seeks a path to greater collaboration, greater care, and greater health. Grief will never be easy, and it will always come with risks, but an open conversation can help us avoid its worst effects.

Slaying monsters: Ethics as a Matter of Opinion

I have the distinct pleasure of teaching ethics to many students who, frankly, do not believe the study of ethics is of any benefit to them or anyone else. From time to time, usually near the beginning of the semester, a student will express frustration that a required ethics class seems a colossal waste of time, as ethics is “just a matter of opinion.” People have to make up their own minds about what is right and wrong, and one opinion is as valid as another.

I challenge this as most ethics teachers challenge it: “So,” I say, “If someone were to kill someone, no one has any moral authority to challenge that person’s opinion that such behavior is perfectly moral.” Students will often then say, “Well, it depends.” I will then assert that whatever it depends on is the fulcrum of the student’s own moral theory—it is a creepcore moral value. With a little engagement, we usually get around to a fairly simple statement of what I do take to be a near universal moral value. It is okay for people to have their own moral opinions and to make their own decisions about their behavior so long as they are not hurting anyone.

Of course, we do hurt people. We execute people. We put people in jail. We take scissors away from running toddlers who would rather play with the scissors. We hurt people in many ways. Most students will agree that it is acceptable to hurt someone with some greater good in mind—or, for some students, it is acceptable to hurt someone as punishment. It hurts to give a child a vaccination, but the purpose is to protect the child and society from disease. It hurts to kill someone who has broken into your home to murder you, but killing the guilty to protect the innocent is considered a good by almost everyone, even as we acknowledge pacifism and non-violent resistance. This being the case, most students will agree that it is wrong to harm someone who is innocent, unless that harm is aimed at a greater good (e.g., I may violently knock someone to the ground to prevent her from falling thousands of feet to her death or give a child a vaccination to protect her from disease).

When we accept that it is wrong, generally, to hurt innocent people, we are left with two questions: 1. What constitutes harm? 2. What is a person? The first question seems easy until we try to answer it. When some information will be extremely painful to someone (say, some embarrassing photos and personal information of someone are posted in an office he is completely unaware of unlikely to ever know about), is it more harmful to tell the truth or to keep a secret? Is failing to prevent a harm the same, morally, as harming someone? Many moral dilemmas revolve around just such questions. Even with these difficulties, though, I don’t think the question of harm is what derails morality. Reasonable people with good intentions can have productive discussions about harm, even if they don’t always arrive at consensus on what harms are or are not justified.

It is the second question that effectively ends progress of moral conversation. We want to say everyone deserves equal protection from harm, but we don’t always agree on who “everyone” is. The founders of the United States purportedly believed “all men” are created equal. Women, slaves, other minorities, and children did not fall under the umbrella of “all men” in either policy or practice. Everyone should be treated equally under the law, but some of us have a fairly narrow view of who “everyone” is.

Some people want only to protect rational beings, which would seem to indicate adult humans, while others want to protect, seemingly, all living things. I spend perhaps too much time trying to understand how people who seem to want to be moral can justify slavery, torture, sexual abuse, or even genocide. In most cases, the people guilty of the horrendous crimes are not amoral; they simply have a morality that does not recognize the rights of their victims. By one way or another, they have come to view their victims as less than human.

Thus, police may view those suspected of crimes as being beneath them and undeserving of respect and thoroughly devoid of dignity. People may view those of other races as being subhuman or animalistic. In the same way, too many people compare sexual minorities with animal behavior or will even refer to “those people” as animals. Women are often viewed, depicted and described as animals or even inanimate objects. The poor, too, are often described as vermin or even rubbish. People often deny the worth and dignity of many classes of people. Though we all come from the same creator (your choice who the creator is: evolution, God, spirits, or whatever), some of us manage to ignore the worth of others in our community.

Religious Friends, Quakers, have the idea that we should always recognize “that of God in everyone.” Even if you don’t believe in God, this idea is a powerful way to examine what others deserve our respect. We all share the same ancestors. We all share the same emotions. None of us is perfect, and no one is without worth. Even for those who have done the worst, dictators, terrorist, and so on, we must remember that they, too, are made of the same flesh.

It is through empathy and compassion that we can better understand our enemies. I am not saying there can never be a justification for punishment or even some defensive acts of violence, but I am saying these acts must be carried out with the full recognition of our own flaws and the humanity of our enemies, opponents, and, yes, friends.

You are not perfect. Try to love another imperfect person today. And tomorrow.

Why I Am Not Your Ally

In response to injustice against members of various communities, those affected rise up, thank goodness, against the injustice accompanied by their allies from outside the community. Thus, the black community has white allies, the gay community has straight allies, women have male allies, and so on. I want to join all these communities in the struggle for justice, but I’ve never felt any connection with the word “ally.” Perhaps I over think things (I’ve certainly been told I do), and I can see why some people would see an “alliance” as a good thing, but I really think the idea of an ally preserves the concept of division and otherness.

The source of most oppression comes from this concept of otherness. Simone de Beauvoir told us, “No group ever sets itself up as the One without at once setting up the Other over against itself.” Thus, she says, “In small-town eyes all persons not belonging to the village are ‘strangers’ and suspect; to the native of a country all who inhabit other countries are ‘foreigners’; Jews are ‘different’ for the anti-Semite, Negroes are ‘inferior’ for American racists, aborigines are ‘natives’ for colonists, proletarians are the ‘lower class’ for the privileged.” It is the distinction between One and Other that is the source of the problem. If the One becomes an advocate for the Other, does this change the balance of power? I argue that it does not. The ally speaks from a position of power on behalf of the less fortunate, often with the expectation that the weaker party will feel and exhibit an overflowing gratitude. At least, that is how it feels to me.

All the same, we can’t ignore our differences from others. It is important to preserve cultural distinctions, for example. Only the Deaf community fully understands the special problems faced by deaf people. Only the Native American community can understand injustices against Native Americans. And so on. What unites us in our struggle, though, is that we all are able to understand what injustice is. Those of us who are outraged, disgusted, and revolted by injustice, will react with those feelings every time we see it, regardless of the specific circumstances or characteristics of the victim. At least this is what I hope. When I react to injustice, I don’t do it because I feel someone deserves my sympathy or respect. I do it because I am offended by injustice. The specific qualities of the victim are not the source of my outrage.

This isn’t to say the specific qualities of the victim are not relevant, especially regarding discussions of how to understand and address the injustice. We need to have conversations so that we can understand each other. As Kwame Athony Appiah put it in his book, Cosmopolitanism, “We take seriously the value not just of human life but of particular human lives, which means taking an interest in the practices and beliefs that lend them significance.” We must also understand the experiences of others. Through conversation, stories, art, music and language we can share experiences and enhance our ability to imagine the lives of others. By understanding the experiences of others, we are better able to understand that their experiences are morally inexcusable.

Affirming justice requires us to see the common humanity we have with others. Those who harbor feelings of innate superiority are easily enticed to barbarous behavior. David Hume notes that Europeans had such feelings of superiority over natives in America that it “made us throw off all restraints of justice, and even humanity, in our treatment of them.” He goes on to describe similar treatment of women, owing to the fact that men “have in all countries bodily force sufficient to maintain this severe tyranny.” Those who are able to disregard the humanity of others and have the power to force them in to submission feel entitled to exercise their power. It is my contention that the person who does not carry feelings of entitlement will be sickened by the abuse of others. When we recognize our shared experiences with others, feelings of entitlement dissolve. When we feel an innate superiority, entitlement is cemented in our psyche.

The people who are most able to recognize their common humanity are those who have experienced injustice or at least recognized the possibility that they might. I don’t mean those threatened by the loss of their own power or privilege but those who recognize that we are all inferior in someone else’s eyes. The rage against injustice against other races or citizens in other countries is a rage against injustice that could befall anyone at any time. Often marginalized and oppressed groups recognize the oppression of other groups before the privileged can see. Declaring that someone is privileged, however, has its own hazards. A person’s oppression may not be readily apparent on his or her face or skin or other aspects of personal appearance. Religious, sexual, gender, and cultural differences are not always visible on the skin, but these differences often lead to extreme oppression and violence.

Occasionally, people are unable, flawed as we all are, to recognize their common humanity allieseven with those with whom they have no discernible differences. Consider the bitter conflict between the Hutu and the Tutsi in Rwanda. In a 1996 interview with Charlayne Hunter Gault, Professor George Izangola described the lack of differences between the two groups: “In Rwanda, the Tutsi and the Hutu are the same people. They are all people–large grouping or communities which go from seven regions of Cameroon to Uganda–all the way to South Africa, in the same culture. People used to be Tutsi or Hutu, depending on the proximity to the king. If you were close to the king, you owned wealth, you owned a lot of cattle, you are a Tutsi. If you are far away from the king, you are a cultivator, you don’t own much cattle, you are a Hutu.” (I’ve taken this quote from PBS here.)

If some of us can deny the humanity of those who look almost exactly like us, then “otherness” is a phenomenon that goes beyond race and gender. We either recognize that we are part of humanity or we do not. One way leads to freedom and the other to fascism. In “The Ethics of Ambiguity,” Simone de Beauvoir declares that we are each in a subjective struggle for freedom but that we are defined in our relationship to others. Our struggle for our freedom entails a will for the freedom of others. She says the activist “exists only by transcending himself, and his freedom can be achieved only through the freedom of others. He justifies his existence by a movement which, like freedom, springs from his heart but which leads outside of him.”

For Beauvoir’s activist, the constant push for freedom is a push for humanity. In this sense, an injustice anywhere is, indeed, a threat to justice everywhere, as the saying goes. The existence of injustice itself destroys the condition of freedom. Resistance is, she says, the annihilation of injustice. In an apparent paradox, I struggle alone but alongside and in relation to others. As your struggle is yours alone, my struggle is mine alone. Rather than acting as an ally seeking justice on your behalf, we must work together to secure freedom on our own account, which requires freedom for all.

Thought experiment: Financial Conflicts of Interest

Believe it or not, many people see no problem with financial conflicts of interest in health care. People who receive payments say they are only doing the same job they would do otherwise, except with more resources. This, they say, enables them to provide better health care. People who make the payments will claim that they are only trying to ensure that their beneficial products are able to improve the lives of as many consumers as possible. Even patients defend conflicts, saying they don’t mind their doctors making a few extra dollars in order to provide efficient, state-of-the-art service. Patients see these financial ties as a way to ensure groundbreaking treatments reach consumers.

I’m not a doctor, but there are analogies for me. If we look at financial ties in another industry, it may be easier to see the problem. In education, the stakes are lower, but some parallels to the medical industry remain. I will begin with actual practices and then ask you to imagine further practices that parallel the medical industry.

First, instructors are commonly asked to review books for publishers seeking feedback on manuscripts or new textbooks. This gives the publisher an opportunity to get feedback from potential customers while also enabling instructors to provide input to publishers. Instructors get better books, and publishers are able to improve both their products and their marketing. The instructor is, of course, paid a small honorarium for the time invested in reading and reviewing the book.

Second, once instructors have given feedback, publishers may invite them to be more involved in the production of the textbook. They may be asked to write an instructor’s manual to accompany the text or participate in developing workbooks or online supporting materials for students. (Disclosure: I know that these first two items are practiced because I have reviewed textbooks and written an instructor’s manual for pay.) Instructors, of course, know the most about what instructors need and how students may use various materials. Improving the product benefits publishers, instructors, and students.

Now, imagine that an instructor sees an improvement in students’ success rates and general aptitude. The instructor begins to collect data and may even present at a teaching and learning conference on how these materials have benefited students. A publisher might (I don’t know of this happening in real life) offer to pay the instructor to give the same presentation at additional conferences. On the surface, this does not seem harmful. After all, the students really did improve using these materials, and the presentation was not developed with the aim of getting payouts from the publisher. Certainly, no students will be harmed by these presentations.

Finally, imagine this instructor begins to accept regular invitations from the publisher to present on the benefits of the products and encourages others to adopt the same materials for their classes. The instructor notes that most of her or his students are now earning A’s and B’s when the class averages were usually a B or C before the materials were adopted. To reward the instructor for this amazing success, the publisher begins to pay the instructor $100 for each A awarded and $80 for each B awarded. Soon, this instructor is widely hailed for improving student success and completion rates at a college that struggles with generally high rates of failure and incompletion.

Now, these payments to the instructor come to the attention of the student newspaper, which publishes the amounts paid to the instructor and the increase in high grades in the classes. The public is outraged, but enrollments in the class continue to increase. The instructor counters that no one has shown that even one student who received an A did not deserve an A. Further, the instructor says that the improvements in student success were documented even before the payments began. The publisher responds by saying that the materials it produces are of the highest quality and that it is proud of the success rates of the students using the products. Without the relationship between the publisher and instructor, fewer students would have benefited from these outstanding educational materials and that would be a real tragedy.

Questions to consider: 1. Did students really benefit from the relationship? 2. Were cheaper alternative materials available that were equally beneficial? 3. Is it possible that students received inflated grades, even if proving it so is impossible? 4. What would it take to identify this relationship as a moral problem? 5. Are all financial relationships with industry unethical? 6. If not, when does the relationship become unethical?

I think it is extremely rare for someone to go into a job with criminal intent to capitalize on the system and take home as much money as possible regardless of possible harm. No, everyone begins with the best intentions and becomes blinded to the possible effects of their actions. And, precisely because each person has no malevolent intentions, each person feels insulted by even a hint of judgment and defends her or his practices vehemently. Because good people do X or Y, it is easy to think it is impossible that X or Y is a bad thing, especially when we can show that many people have benefited from these practices.

åIt is easy to be blinded by the fog of good intentions and financial influence, and ethicists are not immune. The job of the ethicist is not to be perfect but to be on guard. The job of the ethicists is to constantly strive to get a clear view through the fog and to help others stay on the paved path running alongside that slippery slope.

 

Do all ethicists have a messiah complex?

Last May, Nathan Emmerich wrote a column warning that bioethicists must not become a “priestly caste.”In the column, he warns that giving bioethicists moral authority over all practices in medicine and healthcare will have an anti-democratic effect and hinder public discourse.

He may have overstated the authority that bioethicists generally have, but it is true that some see their job as handing down judgment on various practices in medicine and research while others, frankly, would be happier to just accept the opinion of “experts” in order to avoid having to take full responsibility for their ethical decisions. The ethical expert has arisen because of rising demand. After making a thorny decision, who would not want to be able to say, “My decision was reviewed and approved by experts in ethics”?

Ethicists will do well to resist a priestly role. If you begin to believe that something is morally correct simply because you believe or say that it is, then you should apply for sainthood, not a position as an ethics consultant. When Euthyphro is asked if he knows he is doing the right thing, he replies, “The best of Euthyphro, and that which distinguishes him, Socrates, from other men, is his exact knowledge of all such matters. What should I be good for without it?” Euthyphro considers himself an expert on matters of morality and dismisses any suggestion that his opinions might be challenged. As he attempts to explain himself, his logic breaks down. Ethicists as experts would do well to open themselves to challenges from all corners as Emmerich suggests.

All this is further complicated, though, by Eric Schwitzgebel’s finding that ethicists are no more ethical than non-ethicists. Comparing ethicists and other professors, Schwitzgebel and his colleague, Joshua Rust, found that both ethicists and their colleagues reported that the ethicists were no more ethical than their colleagues. This is not terribly surprising. I may think I am a pretty ethical person but not be willing to say my colleagues in metaphysics are a bunch of thieves and charlatans. By the same token, they may think I am pretty ethical but have enough self-respect not to sell themselves short.

Of further harm to the reputation of ethicists, Schwitzgebel says ethics courses do not appear to have much affect on the ethical behavior of students. He notes that many of us who teach ethics do no claim that it will make our students behave more ethically. This is probably true in most philosophy departments, but ethics courses in law schools and business schools, for example, are designed to prevent unethical behavior down the road.

It isn’t likely that any type of ethics course can cause an unethical person to become more ethical, but courses can have an effect on ethical behavior. Courses in specific disciplines can provide a framework for codes of behavior in a particular field such as law, business, psychotherapy, or medicine. Through such courses, students can become well versed in expected norms as well as actual regulations from laws or professional codes of behavior. In addition, students can learn to examine cases and apply accepted principles of their fields to various situations they may encounter during their careers.

Theoretical courses give students a larger ethical toolbox to examine conflicts that arise in their careers and also in their daily lives. Few ethics professors have had students say that, thanks to the ethics class, they have stopped lying and cheating, but most of us have had students tell us that they now see questions in a new light. Rather than simply relying on instinct or prior teaching, students learn new ways to frame ethical problems and new approaches for identifying possible ethical harm. If nothing else, we give the students who are already ethical a greater vocabulary for articulating their actions and beliefs.

With any luck, ethicists, ethics instructors, and students will all leave the class with a bit of humility. The ethicist who believes his or her own hype as a moral authority has passed into dangerous territory. At best, the ethicist has the tools to examine ethical problems with greater detail and nuance. In the end, people eventually have to act, and a thorough ethical analysis can help guide them.

But ethics courses have a greater importance. Imagine a society where no one ever studied or discussed ethical theory or ethical decisions. It is impossible to imagine such as society, I think, because we do have to make decisions, and that requires thinking about them in detail. Some people would always rely on their “gut feeling,” but others would worry and ponder and ruminate. And they might seek the counsel of others who have spent time worrying and pondering and ruminating. And soon we would see the rise of a priestly caste and a separate group of committed but imperfect thinkers devoted to analyzing ethics in both theory and practice. We would make many mistakes, and many people would be hurt, but at least we would be trying.

At least we are trying.

The Ethics of Grief

It seems each time I attend a funeral, I overhear someone being criticized for grieving too subtly, too gregariously, too privately, or while dressed inappropriately. I dismiss the critics as judgmental and ignorant cranks who should have better things to do. We all know that each person grieves differently. We should all be allowed to grieve in our own time and in our own way.

But I wonder whether there is am improper way to grieve. Many of us tell our loved ones not to cry for us when we are gone. We’d rather imagine they will have a party to celebrate our life. We would like for them to pay tribute to us through their own joy. And when people ask us to do this, we promise them we will, even though we know we won’t. We make an impossible promise out of respect for those we love.

But some people take such promises seriously. This past week, I came across a paper by Amy Olberding that discusses different approaches to grief by Seneca and Zhuangzi. In letter 63, Seneca counsels his friend, “We, however, may be forgiven for bursting into tears, if only our tears have not flowed to excess, and if we have lost a friend, nor let them overflow.  We may weep, but we must not wail.” But Seneca goes on to confess that he wailed excessively over the loss of his friend, Annaeus Serenus.

He admits the power of his grief, but admonishes himself, “I must be included among the examples of men who have been overcome by grief.  Today, however, I condemn this act of mine.” In describing Seneca’s position, Olberding says grief for Seneca is “a form of self-injury that neither effect relief from pain nor alter the event that stimulated it.” As a Stoic, Seneca claims that death should not be seen as an injury, so it is wrong to grieve something that is not actually harmful. Many Christians find themselves in a similar state. Should we not celebrate someone’s passage to a blissful eternity?

And Zhuangzi, the Daoist, finds himself in a similar state. Zhuangzi taught that death is a mere transition to another state and nothing to grieve at all. Olberding says the Daoist views death as part of a “global harmony that sustains the natural world.” But when Zhuangzi’s wife died, he also reacted with extreme emotion. He said, “I with my sobbing knew no better than to bewail her. The thought came to me that I was being uncomprehending towards destiny, so I stopped.” Unlike Seneca, Zhuangzi did not express any self-recrimination over his grief.

Whether we consider it appropriate or not, the feeling of grief when something of great value is lost is universal. We are shocked when someone seems unaffected by the loss of someone who should be valued. With later reflection, we can reassess our grief and our loss more rationally and understand death in a larger context, especially if we have, indeed, learned to live without our valued loved one.

In Buddhism, Kisa Gotami also learns to reevaluate her grief after some reflection and guidance from the Buddha and her neighbors. Kisa Gotami had a young son who died, and she carried his body from person to person seeking aid to revive him. Finally, she was directed to the Buddha who asked her to obtain a mustard seed from every house where no one had lost a child, spouse, parent, or friend. After she couldn’t gather even a single seed, she judges herself for being selfish in her grief while remaining ignorant of the suffering of others.

The Buddha tells her, “In whatever manner people think a thing will come to pass, it is often different when it happens, and great is the disappointment; see, such are the terms of the world.” Even when death is expected, it is painful, but surprise intensifies the pain. The loss of young and healthy friends, siblings, and children often shatters the narrative people tell themselves about how the world works.

The advice of Seneca, Zhuangzi, and the Buddha all seem to be good advice, so long as we acknowledge that no human can suppress an immediate expression of extreme grief when faced with loss of someone so valued. As time passes, we may benefit from reminders that death is a transition, that death is universal, and that we can, indeed, live on after our loss. I do realize there are cases where survivors do not seem able to live on after loss, and compassion should move us to try to help those who are crippled by grief or loss of support.

It is true that people grieve in their own way and their own time, but compassionate care, free from judgment, might help people reach acceptance of the reality of a world that often seems to lack moral order, fairness, and predictability.

Teaching Ethics to Greedy Bastards

When a corporate executive, high-powered lawyer, or well-funded medical researcher is exposed for egregious unethical behavior, we often say it would have been a good idea for that person to have had a class in ethics with some follow-up training. We’d like to think that with the proper ethics training even the most heartless sociopath could be encouraged to at least follow some of the rules.

And if we can’t (note: we can’t) encourage bad people to be good people, what are ethicists worth? Well, our roles fall into several categories: 1. Providing ethical answers to dilemmas. 2. Offering ethical analysis of a particular problem. 3. Teaching ethical decision-making, which makes a good-faith assumption that the decision maker is sincere in wanting to be ethical. 4. Holding wrongdoers accountable for their behavior.

The first category is offered to clients who don’t want to take complete responsibility for their ethical decisions. Once a professional ethicist has offered an opinion on whether something is above board, an organization can say, proudly, “All our policies and procedures have been reviewed by someone with extensive training and expertise in ethics and found to be compliant with all ethical and legal codes.” Indeed, it can be a very good idea for an organization to get an outsider to review policies for possible ethical problems.

The second category is related, perhaps a subset of the first. When institutions encounter a particularly sticky issue, they might ask an ethicist to help them work through all the ethical considerations and explore how various ethical theories can help them solve the dilemma. Again, a useful role for the ethicist.

The third category involves training. Rather than giving answers to ethical questions, the ethicist can teach motivated individuals to analyze various conflicts on their own. Most people know how to think ethically, but they sometimes forget some of the considerations that professionals might find to be second nature.  Developing a more thorough approach to ethical approaches can benefit individuals and organization alike. It cannot, however, turn a bad person in to a good one. Evil people don’t lack ethical tools—they lack a conscience.

So, what do we do about the evil people? An important role for ethicists, in my considered and passionately held opinion, is to cry foul when individuals and institutions engage in egregious behavior. And when ethicists disagree on what is an egregious action, fervent debate erupts in the public sphere, benefitting the public and everyone involved, or so it should be. When ethicists sound the alarm that some behavior is abhorrent and shameful, a public chorus against such actions can at least ensure that the bad actors confront public scrutiny.

Think it doesn’t work? Remember in 2011 when executives at Transocean received bonuses for their safety record after the explosion in the Gulf of Mexico killed 11 and sent millions of gallons of oil streaming into the water? After public outcry, the executives thought better of keeping those bonuses and donated them to the Deepwater Horizon Memorial Fund. Social regulation pushes and pulls behavior through honor and shame. In responding to abhorrent behavior, Kwame Anthony Appiah says, “Shame, and sometimes even carefully calibrated ridicule, may be the tools we need. Not that appeals to morality—to justice, to human rights—are irrelevant.”

Most of us evaluate ethical theories in the following way: Knowing that I am an ethical person, which ethical theory best fits my behavior? Following this method, we can all justify our actions through theoretical ethics as we simply seek out the theories that validate our behavior. Given that we all have justification for our behavior, public outcry is not likely to immediately shake our perception of what is appropriate, and, indeed, the public rarely speaks as one voice. Further, the common view is often wrong, or so I judge it to be. Bertrand Russell once said, “In view of the silliness of the majority of mankind, a widespread belief is more likely to be foolish than sensible.” Indeed.

Many people, especially those in power, feel their behavior is beyond reproach. They seem to think they could not have gained power if they were not deserving of it. Public outcry and public discourse, can remind them that they are, in common with the rest of us, flawed and fallible human beings. What this means is that we must raise our voices, express what we find shameful and honorable, and join or create a conversation over morality, dignity, and justice. Only when we suppress our voices do we lose. Only our common humanity makes our salvation possible.

Religion and Morality: You could do more

Immanuel Kant said, “Morality is not properly the doctrine of how we may make ourselves happy, but how we may make ourselves worthy of happiness.” In the past I was of the opinion that if a moral system makes people miserable, it is not a useful moral system at all, but I think perhaps I’m finally starting to grasp Kant’s meaning. Sometimes it takes me longer than I’d like to get things.

It seems to me now that there are two ways of viewing morality. First, we may seek out systems that give us guidance on how we may improve ourselves. Second, we may seek out systems that validate how we already are.

Over the past few decades (or is this problem much older?), we appear to have embraced a massive self-esteem movement that compels us to seek self-validation rather than self-reflection and self-criticism. Christian mega-churches now teach people that God wants them to be happy, so they should pursue whatever makes them happy: luxury homes, cars, vacations, or other possessions. No more are congregants taught the value of restraint and humility. Thus, immediate and intense gratification is combined with the arrogance of ones who must not be questioned. It is not that I want to see medieval flagellants in the streets, but humble servitude and stewardship might be a nice change. I do realize, of course, that such meek worshipers still exist, but they are too quiet to gain so much notice.

And many people who claim to be interested in Buddhism say that it helps them stay centered. By this, they mean, as far as I can tell, that it helps them cope with the stresses life throws their way. But Buddhism as I understand it teaches discipline and awareness of the suffering of life. Suffering is universal, and relief from suffering must also be universal. To relieve your own suffering, you must stop believing in your “own” suffering and work to relieve universal suffering through loving kindness that pervades all your actions, words, and thoughts.   Your relief comes from the kindness you show others and your restraint from pursuing selfish desires, not from freeing your mind of unpleasant thoughts.

Finally, those who are not religious often turn to moral philosophy as a source of comfort. Rather than evaluating a moral system to see how sound it is and what advice it can offer for living a life that is good, proper, and noble, we read for a philosophy that exalts someone who is very much the way we already are.

When corporate leaders and other public figures are criticized for immoral behavior, they often react angrily and declare that it is their critics who are acting inappropriately. Of course, not all criticisms are valid, so sometimes they are correct, but imagine a world where the same people responded with an air of humility. We’ve entered an age where we constantly demand apologies of anyone in the public who says something we don’t like. I find apologies on demand to be extremely unsatisfying. I would much rather hear someone say, “I try to be a good person, but sometimes I make mistakes. I would ask you to show me the same forbearance and forgiveness that I promise to show you.” And maybe we can all set to the task of improving ourselves and our world.

Glenn Beck is shocked by bioethics blog about an article saying killing isn’t really wrong.

By now, commentary on Glenn Beck seems superfluous—his views are so patently divorced from reality, but this topic could use some discussion anyway. In this clip, he responds to a blog titled “Is it morally wrong to take a life? Not really, say bioethicists” by Michael Cook. Beck seems unaware that his comments are actually about an article titled “What Makes Killing Wrong?” by Walter Sinnott-Armstrong and Franklin G. Miller in the Journal of Medical Ethics. Cook, of course, is just commenting on the original article. Although the full article by Sinnott-Armstrong and Miller is available online, Beck obviously did not take the time to read it. Or, if he read it, he certainly does not want his listeners to.

Here’s the problem: Hospital Ethics Committees (or other hospital entities) must develop extremely precise procedures for organ harvesting. They do this because they do not believe it is ethical to kill patients for their organs, nor do they want others to believe, rightly or wrongly, that they kill patients for their organs. Sometimes, when someone is dying from an extreme and irreversible injury (such as a gunshot wound to the head), doctors will begin to remove organs only to have a monitor show a heartbeat or two. This event can be disconcerting.

I can see three alternatives here: 1. Turn off the monitors and declare the patient dead (changing the definition of death, if necessary). 2. Wait till there is no chance the heart may beat again and risk losing organs that could save another life. 3. Declare that the patient is alive but that killing the patient is acceptable.

Most ethicists have tended to suggest some variation of the first two options, but Sinnott-Armstrong and Miller think it is more honest to accept the third. If the heart may still beat, they argue that the patient is not dead but that it is morally permissible to kill that patient. The authors also make it more challenging by imagining a patient in this state for an extended time (on a ventilator or other artificial life support).

Unfortunately, their term for a patient in this state is “universally and totally disabled,” meaning that the patient cannot suffer, feel, think, or have any other function associated with being a living human being. Beck seizes on the term “disabled” and suggests they want to kill all the disabled people in the world. Is Beck being dishonest or did he just miss the point? Does it matter to you?

The final issue for Beck is that the authors said mere life is not sacred or we would not be able to pull weeds without violating the sanctity of life. So, Beck and his followers are incensed that they authors compared human life to weeds. But, of course, they did not.

No, Sinnott-Armstrong and Miller went on to distinguish between the sanctity of “life” and of “human life.” They follow the weed comment with this explanation:

 “Of course, what people mean when they say ‘Don’t kill’ is ‘Don’t kill humans’ (or maybe ‘Don’t kill sentient animals’). But why then are humans (or sentient animals) singled out for moral protection? The natural answer is that humans (and sentient animals) have greater abilities than plants, and those abilities give human lives more value. Humans can think and make decisions as well as feel (an ability that they share with sentient animals). But if these abilities are what make it immoral to kill humans (but not weeds), then what really matters is the loss of ability when humans (but not weeds) are killed. And then the view that human life is sacred does not conflict with—and might even depend on—the view that what makes life sacred (if it is) is ability, so the basic moral rule is not ‘Don’t kill’ but is instead ‘Don’t disable’.”

To be sure, the article in the Journal of Medical Ethics is provocative, and articles in ethics journals should be provocative. Many bioethicists, doctors, and lay people will disagree that killing is ever acceptable. Discussion of this issue is needed and welcome. Distortions, flag waving, and hysteria are not.
